How assessments work in Lee County

Lee County reassesses property every year as of January 1. The Property Appraiser’s calendar says January 1 is the assessment date, July 1 is when assessment rolls are submitted to the Florida Department of Revenue for review and approval, August is when TRIM notices are mailed, October is when rolls are certified for collection, and November is when tax bills are mailed by the Tax Collector. Your appeal is usually about the Property Appraiser’s just value or a denied exemption/classification, not about the tax rate. LeePA’s FAQ says Florida law requires just value to be determined annually and that the Property Appraiser appraises Lee County property at market value as of January 1. (leepa.org)

Do not confuse three numbers on the TRIM notice. Just value is the market-value estimate. Assessed value may be lower because of caps such as Save Our Homes. Taxable value is assessed value minus exemptions and is the number multiplied by millage rates. Whether you should appeal

A good Lee County appeal starts with your parcel record, not your tax bill. Pull the LeePA record and compare the property characteristics: living area, pool, garage, waterfront/canal status, effective year built, land size, condition, and any hurricane or construction issues that existed on January 1, 2026. If the record overstates your home, fix that informally with LeePA and still watch the VAB deadline.

The strongest value evidence is usually recent comparable sales that closed before January 1, 2026 and are truly comparable in neighborhood, size, condition, view/water access, and effective age. A Zestimate-style number is weaker than three to five sales with adjustment notes. If your homesteaded assessed value is far below just value because of SOH, a reduction in just value may not lower this year’s bill unless it also lowers assessed/taxable value.

Check exemptions before filing a value-only petition. LeePA lists homestead, senior limited-income exemptions, 25-year senior exemptions in participating jurisdictions, widow/widower, blind, disability, veterans’ disability, deployed service member, and first-responder benefits. Senior exemption amounts vary locally: LeePA lists additional senior exemptions adopted by Lee County millages and municipalities including Cape Coral, Bonita Springs, Fort Myers, Sanibel, Fort Myers Beach and Estero. I could not find an official Lee County publication showing residential VAB success rates, median reductions, or win rates. The Clerk does say VAB records, recommendations, decisions and tax impact reports are maintained in the Minutes Office, and a Lee Clerk annual report notes the office administers more than 4,000 VAB petitions annually, but that is not an outcome statistic. Step-by-step how to file

1. Read the TRIM notice the day it arrives. LeePA says property owners have 25 days from the TRIM mailing date to file a VAB petition contesting value; the Clerk says the deadline is printed on the TRIM notice. A petition must be received by the deadline. (leepa.org)

2. Try LeePA first, but do not wait. LeePA says owners may request an informal conference with the Property Appraiser at any time during the year. Florida DOR warns that an informal conference does not extend the VAB petition deadline. (leepa.org)

3. Use the correct form. For a residential value appeal, use Florida DOR DR-486, Petition to Value Adjustment Board – Request for Hearing. For portability, use DR-486PORT. What happens after

Lee County’s appeal authority is the Lee County Value Adjustment Board. It is an independent board created under Chapter 194, Florida Statutes, and consists of two County Commissioners, one School Board member, one County Commission-appointed citizen member and one School Board-appointed citizen member. If your issue is not settled with LeePA, the petition is scheduled before a Special Magistrate. Lee’s local procedures say the Clerk acknowledges timely petitions, assigns a petition number, and gives a transaction number/password to check hearing status and access the online record. The hearing is formal but not a courtroom trial. Lee’s Special Magistrate opening statement says the magistrate is independent and impartial, the Property Appraiser presents first on the presumption of correctness, both sides present evidence and testimony, each side may cross-examine witnesses, and the magistrate may decide later rather than orally at the hearing. Evidence matters. Lee’s local policy says petitioner evidence uploaded into Axia is admissible if uploaded at least 15 calendar days before the hearing, or within a reasonable time if not available then, but uploading into Axia alone does not commence statutory evidence exchange. If you choose a non-appearance hearing, Lee requires evidence to be uploaded into Axia before the hearing; if you cannot upload, one copy must be provided to County Records Services at 2201 Second St, 3rd Floor, Fort Myers, FL 33901, or PO Box 2469, Fort Myers, FL 33902 at least 15 business days before the hearing. Decision timing is not instant. Lee’s email-final-decision form says the Special Magistrate prepares a recommended decision after the hearing, the VAB endeavors to provide the recommended decision about 30 days after the hearing, and the final decision is sent as soon as possible after the VAB meeting that reviews the recommendation. Local tips

For a realistic savings example, use your exact TRIM millage code. A Cape Coral homeowner in tax district 057 can use the 2025 LeePA millage book’s actual total ad valorem rate of 15.3806 mills; the book notes this does not include non-ad valorem special assessments. If that homeowner proves a $50,000 taxable-value reduction that actually flows through to taxable value, estimated annual ad valorem savings are $50,000 × 15.3806 ÷ 1,000 = $769.03. (leepa.org)

That example is deliberately limited. If you live in Fort Myers, Estero, Bonita Springs, Sanibel, Fort Myers Beach or unincorporated Lee County, your millage stack may be different. Also, garbage, sewer, lighting, drainage and other non-ad valorem assessments may still appear on the November bill and generally do not fall just because your market value is reduced. Finally, if you win after paying the tax bill, Lee’s local policy says you must contact the Tax Collector directly to discuss the refund process.
